Compliance tips for small clarifiers with Clean Water Act discharge permits

The Office of Compliance and Compliance Assurance of the United States Environmental Protection Agency ("EPA") released a document in March 2022 entitled:

Compliance Guide for Small Clarifiers with Clean Water Act Discharge Permits ("Notes")

The guide was developed by the National State Enforcement Initiative/EPA NPDES SNC Working Group.

The declared goal is to support owners and operators of small public and private sewage treatment plants in complying with the law. Because the EPA says:

. . . Approximately 60% of the facilities that have recently suffered "significant non-compliance" (SNC) with their Clean Water Act National Pollutant Discharge Elimination System (NPDES) permit are wastewater treatment plants.

The notice provides information on Lagoon Treatment Facility violations such as:

  • Causes of Non-Compliance
  • Possible solutions in case of non-compliance

The information contained in the notice is divided into three elements, namely:

  • Overview of the sewage lagoon
  • Background of troubleshooting issues
  • Solutions to the underlying causes of sewage lagoon effluent breaches

The notice also contains references to:

  • Compliance support resources
  • Possible funding and funding sources
  • General references and webinars
