Cleaning company Otsego and others accused of multiple tax crimes

S T. PAUL, Minnesota - The Ministry of Finance of Minnesota announced that the law firm Ramsey County recently Kelly Lynne Kiffmeyer, Otsego, three cases of filing tax returns for false or fraudulent sales and the company Kelly Kiffmeyer Inc., d / b / a Krispy Clean Restoration with three cases of willful non-payment or collection of sales tax. The Ramsey County Attorney's Office charged Brian Roger Posch, of Plymouth, on three cases of knowingly making or knowingly assisting in false or fraudulent VAT returns.

According to the complaints, Mr. Posch owned and operated a cleaning service, Krispy Clean Inc., until his 2012 sales tax license was revoked for underreporting and underpaying sales tax. Mr. Posch still owes more than $ 400,000 in unpaid taxes, penalties, and interest related to his business.

About a year after Mr. Posch's VAT license was revoked, Ms. Kiffmeyer's company, Kelly Kiffmeyer Inc., filed an alias certificate from Krispy Clean Restoration, a company that provides similar services to Mr. Posch's previous business. The complaints indicate that through bank account information and contact with ex-customers, the ministry's investigators found that Mr. Posch was regularly involved in the deal, doing the job, making estimates and communicating with customers and insurers. According to the complaints, Kelly Kiffmeyer Inc. filed false annual sales tax returns in 2017, 2018 and 2019, and reported significantly fewer taxable sales each year. The complaints indicate that Ms. Kiffmeyer and the company owe more than $ 20,500 in sales tax, penalties, and interest.

A maximum of five years in prison, a fine of $ 10,000, or both, is imposed for any tax offense. The defendants are presumed innocent until proven guilty.

Although most taxpayers voluntarily comply with tax laws, the department is taking enforcement action against non-compliant taxpayers to ensure that tax laws are administered fairly.
